These Terms of Service ("Terms") govern your use of the Janadesh Karyakarta mobile application ("the App"). By registering for, installing, or using the App you agree to these Terms. If you do not agree, do not use the App.
The App is an authorised field-operations tool for booth-level party workers. It is not a consumer app. It is distributed only to verified workers whose registration has been approved by the political party or elected representative they work for ("the Principal").
These Terms work alongside the Privacy Policy, which explains what data the App collects and how it is handled. Where these Terms describe how personal data is processed, the Privacy Policy governs.
1. The Principal–EMRL–karyakarta relationship
The App has three parties, and your rights differ against each:
- You (the karyakarta) are an approved field worker registered under a Principal.
- The Principal — a political party or elected representative — deploys the App for its own internal field operations. The Principal is the data controller and decides who is approved, what work is assigned, and what happens to the records you create.
- EMRL builds and operates the App, the back-office dashboard, and the supporting infrastructure on the Principal's behalf, acting as the data processor under a written agreement.
When these Terms say "we" or "us", that means EMRL acting in that capacity. Your working relationship — including any stipend, honorarium, assignment, or discipline — is with the Principal, not with EMRL. EMRL does not employ, engage, or pay karyakartas, and nothing in these Terms creates an employment, agency, partnership, or joint-venture relationship between you and EMRL.
2. Not a government service
The App is not a government application. It is a private field tool published by EMRL on behalf of authorised political clients. It is not affiliated with, endorsed by, or connected to any government department, the Election Commission of India, or any public authority.
The App's About screen links to official government portals and helplines purely for your convenience. Those sites are operated by their respective authorities, not by us. We do not control their content or availability, and linking to them does not imply any endorsement or association in either direction.
Do not represent yourself to any citizen as a government official, and do not represent the App as a government service, scheme portal, or official record system.
3. Eligibility and authorised use
To use the App you must:
- be 18 years of age or older;
- be a genuine field worker authorised by the Principal, whose registration has been approved by the Principal's administrative team;
- register using a mobile number that you personally control; and
- use the App only for the Principal's lawful field-operations purposes.
Approval is granted by the Principal and may be withdrawn by the Principal at any time. Access to the App is a permission, not an entitlement.
4. Your account and authentication
- You sign in with your registered mobile number and a one-time password (OTP). Do not share your OTP with anyone, including anyone claiming to be from EMRL or the Principal's office. We will never ask you for it.
- You are responsible for everything done through your account. If your phone is lost or stolen, or you suspect someone else has used your account, tell the Principal's administrator immediately and write to compliance@eshamedia.com.
- Changing your registered number requires verification, including the last four digits of the Aadhaar number on your profile, and revokes your existing sessions. A cooldown applies after a successful change to reduce SIM-swap abuse.
- One karyakarta, one account. Do not register multiple accounts, register on behalf of another person, or let another person use your account.
5. Acceptable use
You agree that you will not:
- Enter information you know to be false, fabricated, or materially misleading — including invented household visits, fabricated grievances, inflated turnout or booth figures, or activity logged for work you did not do.
- Manipulate performance metrics, points, or activity records, including by submitting duplicate or automated entries.
- Use the App to harass, intimidate, threaten, defame, or discriminate against any person, or to incite hatred or violence on any ground, including religion, caste, community, sex, or place of birth.
- Use the App to promote, offer, or record any bribe, inducement, or other corrupt practice.
- Copy, export, publish, sell, or otherwise disclose voter, citizen, or household data obtained through the App to anyone outside the Principal's authorised chain, or use it for any purpose other than the Principal's field operations — including personal, commercial, or other political purposes.
- Trigger the SOS or emergency features other than in a genuine emergency.
- Access, or attempt to access, data belonging to booths, wards, or workers you are not assigned to; or attempt to bypass any access control, authentication, or rate limit.
- Reverse-engineer, decompile, tamper with, or attempt to disrupt the App or its backend, or run automated tools against it.
- Use the App in any way that breaches Indian law, including the Representation of the People Act 1951, the Indian Penal Code / Bharatiya Nyaya Sanhita, the Information Technology Act 2000, and the Digital Personal Data Protection Act 2023.
- Use the App in breach of the Election Commission of India's Model Code of Conduct where it is in force, or in breach of any lawful direction, order, or silence-period restriction issued by a competent authority.
You remain personally responsible for your own conduct in the field. The App records what you enter; it does not authorise the conduct.
6. Information you record about other people
Much of what you enter concerns other people — household members, voters, complainants, and contacts. This carries obligations:
- Collect information only where the person is aware you are recording it for the Principal's field operations, and only what is relevant to that work.
- Do not record sensitive details you were not given for this purpose, and do not photograph or record anyone who objects.
- If a person asks you not to record their details, or asks that their record be removed, stop and raise it with the Principal's administrator.
- Never use information about a citizen to pressure, threaten, shame, or exclude them.
The Principal is the controller of that data and is responsible for its lawful basis. If you have reason to believe you are being asked to collect data unlawfully, you may raise it with our Grievance Officer under Section 13.
7. Content, ownership, and licence
- The App, its design, code, text, and branding are owned by EMRL or its licensors. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App for the Principal's field operations for as long as your registration remains approved. No other rights are granted.
- Records you create — family entries, grievances, ground reports, photographs, and similar — are created for and belong to the Principal, as part of its field operations. You grant EMRL the right to host, process, and transmit that content strictly as needed to operate the App on the Principal's behalf.
- Your personal profile data is handled as described in the Privacy Policy. These Terms do not give EMRL any right to use your personal data for its own purposes.
8. Availability, changes, and offline use
The App is provided on an "as available" basis. We may add, change, suspend, or remove features, and may require you to update to a supported version. Some modules are enabled or disabled by the Principal, so what you see may differ from what another worker sees.
The App can hold data on your device while you are offline and sync it later. Offline entries are not recorded on our servers until they sync. We do not guarantee that unsynced data will survive an app uninstall, a device reset, or a device failure.
We may carry out maintenance, and service may be interrupted by factors outside our control, including network, device, and third-party failures.
9. Suspension and termination
- The Principal may withdraw your approval at any time, which ends your access.
- We may suspend or terminate access, with or without notice, where we reasonably believe these Terms have been breached, where required by law or by the Principal, or where continued access presents a security risk.
- You may stop using the App at any time and may delete your account (Section 10).
Suspension or termination does not by itself delete the records you created — those belong to the Principal's field operations and are handled under the Privacy Policy's retention rules.
10. Deleting your account
You can delete your account from Profile → Delete account in the App, or from any browser at:
https://auth.janadesh.app/delete-account?app=karyakarta
You can also request deletion by writing to compliance@eshamedia.com from your registered number.
Deletion is confirmed with your Aadhaar last-4 and an OTP. Your account is flagged immediately and your sessions are revoked, then held for 30 days — during which signing in again restores it — after which your personal data is permanently anonymised. Family records you logged are transferred to the successor karyakarta rather than erased, because they describe other citizens on your booth. The full mechanics, including exactly which fields are cleared, are in Section 6 of the Privacy Policy.
11. Disclaimers and liability
To the fullest extent permitted by law:
- The App is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or uninterrupted availability.
- We do not warrant that data shown in the App — including voter lists, booth geography, scheme information, or figures entered by other workers — is accurate, complete, or current. Do not rely on the App as an authoritative record. For official information, use the government portals linked in the About screen.
- We are not liable for indirect, incidental, special, or consequential loss, or for loss of profit, data, goodwill, or opportunity.
- We are not liable for acts or decisions of the Principal, including approval, assignment, stipend, discipline, or removal.
- Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, or for death or personal injury caused by negligence.
12. Indemnity
You agree to indemnify EMRL and the Principal against claims, losses, and reasonable costs arising from your breach of these Terms, your misuse of data obtained through the App, or your unlawful conduct in the field.
13. Grievance Officer
In compliance with the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023:
Grievance Officer Esha Media Research Limited (EMRL) CIN: L72400MH1984PLC322857 Email: compliance@eshamedia.com Address: T 14-16, A Wing, 2nd Floor, Satyam Shopping Centre, Ghatkopar (E), Mumbai, India - 400077
We will acknowledge your grievance within 48 hours and resolve it within 30 days.
For complaints about the Principal's own decisions — approval, assignment, or payment — contact the Principal's administrative team; those decisions are not ours to make.
14. Governing law and jurisdiction
These Terms are governed by the laws of India. The courts at Bengaluru, Karnataka have exclusive jurisdiction, subject to any right you have to bring proceedings before a consumer forum or other authority where that right cannot be excluded by agreement.
15. Changes to these Terms
We may update these Terms. When we do, we will change the "Last updated" date above and publish the revised version at https://janadesh.app/terms/karyakarta.html. Where a change materially affects your rights or obligations, we will give notice in the App or by SMS to your registered number. Continuing to use the App after a change takes effect means you accept the revised Terms.
16. General
- If any provision of these Terms is held unenforceable, the rest remain in force.
- Our not enforcing a provision is not a waiver of it.
- You may not assign these Terms. We may assign them to a successor in connection with a reorganisation or transfer of the business operating the App.
- These Terms, together with the Privacy Policy, are the entire agreement between you and EMRL regarding the App.
